Terms of Service – Mystic Sanctuary

Welcome to Mystic Sanctuary! These Terms of Service (“Terms”) govern your use of our website and services. By accessing or using our platform, you agree to be bound by these Terms.
1. Overview
Mystic Sanctuary operates as an online store specializing in Trading Card Game (TCG) products in South Africa, including single cards, sealed products, accessories, and collectibles.
2. Eligibility
You must be at least 18 years old, or have permission from a parent or guardian, to make purchases on this site.
3. Products & Orders
All product listings are subject to availability and may be withdrawn or modified at any time. Prices are listed in ZAR (South African Rand) and include VAT where applicable. Mystic Sanctuary reserves the right to cancel or limit any order at its discretion.
Stock Availability & Inventory Accuracy
Due to the nature of TCG products, stock levels may occasionally be inaccurate or become unavailable after purchase. If an item cannot be supplied:
- Mystic Sanctuary will refund the item in full; or
- Attempt to source the item if possible. If sourcing is not possible or acceptable to the customer, a refund will be issued promptly.
Order Cancellation Rights
Mystic Sanctuary may cancel an order, in full or in part, at its sole discretion for reasons including (but not limited to):
- Stock discrepancies
- Pricing errors
- Fraudulent or high-risk transactions
- Supplier or operational limitations Cancelled items will be refunded to the customer.
4. Payments
We accept secure payments via EFT, PayFast, and Credit/Debit Card. All transactions are processed in ZAR.
5. Shipping & Delivery
Delivery is within South Africa via courier. Delivery times range from 2 to 5 working days depending on location. Tracking information is provided once your order ships. Shipping fees are calculated at checkout.
Risk Transfer
Risk passes to the customer once the courier confirms delivery. Mystic Sanctuary is not liable for missing items after confirmed delivery unless the customer provides verifiable evidence in accordance with our policies.
Damaged or Tampered Parcels
Damaged or tampered parcels must be photographed immediately upon delivery. Evidence must be submitted to accounts@mysticsanctuary.co.za.
Packages not insured, or where insurance was declined, remain the sole responsibility of the customer.
6. Returns & Refunds
Eligible returns must be in original, unopened condition and initiated within 7 days of delivery. Return shipping is the customer’s responsibility unless the product was incorrect or damaged.
Refunds are issued only after inspection and cannot be granted solely on photographs. Claims must comply with all documentation requirements in our Refund Policy.
Mystic Sanctuary will not issue refunds unless an error on our part has been verified beyond reasonable doubt. Fraudulent or unsupported claims may result in account suspension or legal action.
7. Card Conditions & Variants
Mystic Sanctuary strives to list card conditions, variants (Foil, Edition, Language), and product attributes accurately. Customers must review product details before purchase.
Claims regarding condition disputes or missing cards must be supported by verifiable evidence.
8. User Accounts
Users are responsible for maintaining account confidentiality. Mystic Sanctuary may suspend or terminate accounts that violate these Terms.
9. Privacy & Data Protection
We adhere to POPIA. Personal data is processed in accordance with our Privacy Policy.
10. Limitation of Liability
Mystic Sanctuary is not liable for indirect, incidental, or consequential damages. Maximum liability is limited to the amount paid for the product in question. We are not liable for missing item claims after confirmed delivery unless supported by verifiable evidence. Customers must document issues in accordance with our Shipping and Refund Policies.
11. Customer Conduct & Abuse Policy
To protect our staff and business integrity, Mystic Sanctuary strictly prohibits:
- Abusive, threatening, coercive, or harassing communication
- Defamatory statements about our business or staff
- Intentionally fraudulent, misleading, or opportunistic claims
Mystic Sanctuary reserves the right to:
- Refuse service to customers engaging in hostile or abusive conduct
- Decline unverified, late, or unsupported missing-item claims
- Terminate communication once a reasonable resolution has been offered
- Cancel and refund any part of an order where the customer’s conduct violates these Terms
These rights may be exercised at Mystic Sanctuary’s sole discretion.
All communication, order data, and claim-related information may be documented for dispute resolution.
12. Dispute & Claim Requirements
All claims relating to missing, incorrect, tampered, or damaged items must:
- Be reported within the timeframe specified in the Shipping & Refund Policies
- Include supporting evidence such as photographs, packaging images, and relevant documentation
Claims failing to meet these requirements may be declined.
Mystic Sanctuary reserves the right to refund rather than replace any item that:
- Is unavailable or out of stock,
- Cannot be sourced within a reasonable timeframe,
- Or forms part of a disputed claim lacking evidence.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. All disputes will be resolved in South African courts. Both parties agree to attempt mediation before formal legal action.
Mystic Sanctuary reserves the right to present documented communication, order logs, and verification results in any dispute or legal process.
14. Changes to Terms
We may update these Terms at any time. Updated versions will be posted on this page.
